Is It Unethical If The Agent Refused To Inform The Buyer Of A ...

questions

Q: The listing agent refused to present sellers counter offer to interested buyer. Is this a violation of Code of Ethics and is there any specific New York State law that addresses this?
?Doug, Hauppauge, NY

A: If you are certain that the listing agent did not present the counter offer to the buyer, then you need to bring that up to the attention of the broker-in-charge. Read over the listing agreement and learn the specifics of your rights in the situation ? their refusal to carry out your orders (provided there is nothing illegal/unethical being asked) could be justification for you to cancel the listing agreement.

A: I am not familiar with New York State law; however, to the best of my knowledge this is a violation of the Code of Ethics. Please contact the National Association of Realtors in New York State for further assistance. www.nysar.com/

A: You can contact www.DRE.org or call them. But unless the buyer?s had instructed the agent not to present under certain specifics, the agent has an obligation to submit any offer to anyone.
